Terms of Service for Individuals
Okapi Wanderers Rugby FC website is operated by Pitch Hero Limited ("We" "Us" "Our" "Pitchero"). Pitchero It is registered in England and Wales under company number 06361033 and have Their registered office at Sterling House, Capitol Park East, Tingley, Leeds, West Yorkshire, WF3 1DR.
Description of service
The Service is web-based and allows users that register for an account to use the Service (each an “Account Holder”) to create and update an online profile on the Website. Once registered with the Service, each Account Holder receives his or her own profile on which to post Content (as defined in clause 8.1). Unless explicitly stated otherwise, any new features that augment or enhance the current Service, including the release of new Pitchero tools and resources, shall be subject to these Terms.
In order to use the Service, you must arrange for access to the Internet and provide all equipment necessary to make such connection. Our Service may include certain communications from Us, such as service announcements, administrative messages and the Pitchero newsletter, which are considered part of Pitchero membership, although you will be able to opt out of receiving them. You agree not to access the Service by any means other than through the interfaces that are provided by Pitchero for use in accessing the Service.
Users under 14 years of age may access the Website but cannot be an Account Holder or create a Okapi Wanderers Rugby ID.
In order to use the Service, you must have a valid Okapi ID. To be an Account Holder with your own account, you must provide Okapi with a valid email address and other information ("Registration Data"). As an Account Holder, you will choose a password and account designation for your account during the Service's registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account.
You agree to immediately notify Us in writing of any unauthorised use of your password or account or any other breach of security and you must ensure that you exit from your account at the end of each session. We will not be liable for any loss or damage arising from your failure to comply with this clause
You agree to provide true, accurate, current and complete information about yourself as prompted by the Service's registration form, and you must maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, We have the right to suspend or terminate your account and refuse any and all current or future use of the Service (or any part thereof).
Charges and payment
Some of our packages are only available if you pay for them.
You can pay for a online by credit card or by setting up a monthly direct debit (preferred method). You can also pay by cheque or electronic bank transfer although these methods may incur administration charge. If you want to pay by bank transfer our bank details are available upon request. Cheques should be made payable to Okapi Wanderers Rugby FC and posted to Okapi Wanderers Rugby FC Inc 2439 deer creek road , Weston Florida 33327.
All payments (except cheques) are processed via 3rd party payment providers and we will not have access to your card and/or bank details at any time.
The charges will be payable in advance and you can choose whether to pay monthly or annually. If you pay online by credit card or direct debit we will automatically take payment each month/year (as applicable) and will continue to do so until you advise us otherwise.
You can cancel your membership (moneys earned are non refundable).
We may also issue you with a refund only if the unavailability is due to our act or omission.
If we are unable to collect payment for any reason or you fail to pay the charges, we may suspend your membership until we receive payment in full and in cleared funds.
We reserve the right to change the charges at any time by giving you not less than 30 days' notice.
Cancellation and termination
If you cancel the Service, your cancellation will take effect immediately. After cancellation, you will no longer have access to your profile and all information contained therein may be deleted. We accept no liability for such deleted information or content.
We may, in our sole discretion, terminate your password, and/or account, and remove and discard any Content within the Service (including, but not limited to your website if you are an Account Holder), for any reason, including and without limitation, the lack of use, or if We believe that you have violated or acted inconsistently the Terms. Any contracts, verbal or written, in conjunction with your deleted website, will, at Our discretion, be terminated as well. We may also, in our sole discretion and at any time, discontinue providing the Service, or any part thereof, with or without notice.
You agree that any termination of your access to the Service under these Terms may be effected without prior notice, and you acknowledge that We may immediately deactivate or delete your website and all related information and files. We reserve the right to bar any further access to such files or the Service. We will not be liable to you or any third-party for any termination of your access to the Service.
Data and privacy
For the purposes of data protection legislation, We use a data controller. They process your personal data to enable you to make use of the various goods and services We offer and ensure the security of your account. Pitchero may also use your data for marketing purposes and/or marketing and commercial use by third parties.
When you upload any videos or photos onto Our Website, you agree to grant us a licence in accordance with clause 11.2 and We shall be free to use such videos/photos as We see fit. Where this happens, We will become data controller in respect of the videos/photos. Where you upload videos or photos of third parties, you will be asked to confirm you have their consent to do so.
Ownership of website account and security
You are responsible for maintaining the security of your account and profile, and you are fully responsible for all activities that occur under the account and any other actions taken in connection with the website. You agree to notify Us immediately in writing of any unauthorised use of the account or any other breaches of security. We will not be liable for any loss or damage from your failure to comply with this clause 7. Under no circumstances will We be liable, in any way, for any acts or omissions by an Account Holder or a Guest.
Content and content rules and obligations
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, goods, products, services or other materials ("Content") are the sole responsibility of the person from which such Content originated. You are entirely responsible for all Content that you upload, post, transmit or otherwise make available via the Service. We do not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such Content.
You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will We be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, transmitted or otherwise made available via the Service.
We do not pre-screen Content, but We and Our designees shall have the right (but not the obligation) in Our sole discretion to refuse, move or delete any Content that is available via the Service. upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; and
interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service.
Viruses, hacking and other offences
You must not misuse Our Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to Our Site, the server on which Our Site is stored or any server, computer or database connected to Our Site. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and We will co-operate with those authorities by disclosing your identity to them. Pitchero owner or the licensee of all intellectual property rights in the Service, Website, and in the material published on it and any necessary software used in connection with the Service ("Software”). These works are protected by copyright laws and treaties around the world. All such rights are reserved. Except as expressly authorised by Us or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part.
Subject to clause 6.3, We do not claim ownership of the Content you place on your website. By submitting Content to Okapi Wanderers Rugby FC for inclusion on our website, you grant Us a world-wide, royalty-free and non-exclusive perpetual licence to reproduce, modify, adapt, distribute, sub-licence and publish the Content.

Social networking, such as Twitter, Facebook, whatsapp groups, internet blogs and other online sites, offers tremendous opportunities for rugby to communicate and engage with a growing audience as well as its existing members, supporters and players.
Okapi Wanderers Rugby FC, is keen to promote the safe and responsible use of social networking technology but also to make its members aware of the potential risks and to share best practice.
• Participants should be aware that comments which bring the game into disrepute, or are threatening, abusive, indecent or insulting, may lead to disciplinary action.
• Comments that include a reference to a person’s ethnic origin, color, race, nationality, faith, gender, sexual orientation or disability may attract a high disciplinary sanction.
• Comments can also attract civil and criminal action.
• These are public forums, so treat them as such.
• Individuals and organizations are strictly responsible for any posting on his/their account/s.
• Re-posting or re-tweeting inappropriate content represents an endorsement of that content and can be actionable.
• Do not use abusive, derogatory, vulgar or sexual language.
• Do not criticize or imply bias against match officials.
• At all times, exercise discretion and respect for clubs, players, fans and the game’s partners.
• Deleting or apologizing publicly for an improper posting does not prevent disciplinary action being taken.
• Consider “protecting” Tweets and changing security/visibility of Facebook accounts.
It is recommended that Clubs:
• Set standards for content generated in line with the Core Values and the guidelines above.
• Establish protocols for monitoring output, moderating content in online forums and removing offensive postings.
• Hold members to account for any breaches.
Players and Officials
Individuals need to understand that they are personally responsible and liable for their comments and postings. At all times you should exercise discretion and be respectful of other players, teams, officials, organizations. What you regard as “banter” could be regarded as embarrassing or hurtful by a wider audience and bring the game into disrepute.
In short, follow the general guidelines above and:
• Don’t comment if you have any concerns about the consequences
• Don’t link to unsuitable content
• Don’t get into disputes with anyone
• Don’t share or elicit personal detail
• Do show your personality and be approachable
• Do share your achievements
